Silicon Valley guns for Dianne Feinstein over encryption bill

The tech industry and others are slamming the bipartisan encryption bill from U.S. Sens. Dianne Feinstein, the California senator, and Richard Burr, a Republican from North Carolina.

The official draft of the bill was released this week showing itself to be as flawed as its leaked draft, say critics. It essentially “outlaws encryption,” writes the Mercury News in an editorial.

It’s one thing if this bill came from lawmakers who didn’t know or understand the tech industry. As Sen. Burr put it, the tech industry uses “the same tired argument” when it comes to the encryption debate, as Politico noted.

But of course, Feinstein is from California. That means her bill is viewed more personally.

The bill, says the Merc editorial, is Feinstein’s “most shocking example of her lack of understanding of the most basic Silicon Valley and e-commerce fundamentals.”

Feinstein’s distance from the tech community has been an issue for years, as I wrote in Politico. While many in the industry appreciate Feinstein’s careful deliberation over the issues, it’s long been clear that she doesn’t have the tech industry’s back, they say.

The bill would require “all covered entities” to provide data to law enforcement if presented with a court order. In addition, the companies must provide “appropriate technical assistance” to help law enforcement if it can’t find what it is looking for.

Gary Shapiro, chief executive of the Consumer Technology Association, which counts Apple as a member, tweeted:

It’s unclear from early reports how much support the bill has in the Senate. More than 40,000 people have signed a petition organized by the advocacy group Credo Action stating their opposition to the bill.

The tech industry will look to Sen. Mark Warner, a Democrat from Virginia, who has proposed a commission on the issue with Rep. Michael McCaul, a Texas Republican.

And they will turn too to Sen. Ron Wyden, the Oregon Democrat, to put up the fight.
